HOSPITE acknowledges both to the CONSUMER CUSTOMER (on the website also PRIVATE) and to the PROFESSIONAL CUSTOMER (on the website also PROFESSIONAL or BUSINESS) the right of withdrawal established by law in favour of the CONSUMER CUSTOMER, pursuant to art. 49 et seq. of the Italian Consumer Code, without stating the reasons thereof.
This right of withdrawal has to be exercised within and no later than 14 days from delivery in the case of the purchase of goods or from the conclusion of the contract in the case of the purchase of a service. In order to exercise the right of withdrawal, the CUSTOMER shall inform HOSPITE of his/her decision to withdraw from the contract by means of an explicit communication, to be sent by registered letter with return receipt to be sent to HOSPITE – CUSTOMER assistance service in Villorba – 31020 (TV) – Vicolo G. Verdi n.65 or by pec to the address hospitesrl@legalmail.it.
For this purpose, the CUSTOMER shall use the attached form.
In order to comply with the withdrawal period, it is sufficient for the CUSTOMER to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires. As a consequence of withdrawal, the CUSTOMER shall be reimbursed all amounts paid to HOSPITE, including delivery costs, without undue delay and in any case no later than 14 days from the day on which HOSPITE was informed of the CUSTOMER’s decision to withdraw from the contract. Such refunds shall be made using the same means of payment used by the CUSTOMER for the initial transaction, unless the CUSTOMER has expressly agreed otherwise; in any case, the CUSTOMER shall not incur any costs as a consequence of such a refund. The refund may be suspended by HOSPITE until receipt of the goods or until the CUSTOMER proves that he/she has returned the goods.
The direct costs of returning the goods shall be borne by the CUSTOMER. It should be noted that, due to their nature, such goods can normally be returned by postal service. The CUSTOMER shall be responsible for the decrease in the value of the goods resulting from handling the goods other than what is necessary to establish the nature, characteristics and functioning of the goods. HOSPITE recalls that the right of withdrawal is excluded in relation to service contracts after the complete performance of the service, the CUSTOMER having in this sense given his express consent to the performance of the service in the purchase order and having accepted that he shall lose his right of withdrawal following the complete performance of the contract by HOSPITE.
HOSPITE also recalls that the described right of withdrawal is excluded with respect to the purchase of products of digital content by means of a non-material support if the performance has begun, in this sense, the CUSTOMER having provided in the purchase order his/her express consent to begin the service during the period of the right of withdrawal and acknowledging that he/she shall lose his/her right of withdrawal. In the case of a digital content product, the services shall be considered to have been performed at the time when the credentials on the dedicated platform are activated.
